AI Image Enhancement for Webflow

1. ACCEPTANCE OF TERMS

By installing, accessing, or using the AI Image Enhancement extension for Webflow ("Extension", "Service", "App"), you ("User", "You") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Extension.

2. DESCRIPTION OF SERVICE

The AI Image Enhancement extension is a Webflow Designer Extension that provides:

• AI-powered image enhancement capabilities for existing Webflow project images
• AI-powered image generation functionality
• Integration with third-party AI services (primarily Google Gemini API)
• Client-side processing using user-provided API credentials

3. USER RESPONSIBILITIES AND REQUIREMENTS

3.1 API Key Management

• You are solely responsible for obtaining, securing, and managing your Google AI Studio API key
• You must comply with Google's AI Studio Terms of Service and usage policies
• You are responsible for all costs and charges associated with your API usage
• We are not responsible for any unauthorized use of your API credentials
• localStorage Warning: If you choose to save your API key locally, you do so at your own risk and are responsible for the security implications
• Security Responsibility: You acknowledge that localStorage is not encrypted and may be accessible to other scripts

3.2 Content Responsibility

• You are solely responsible for all images, prompts, and content you process through the Extension
• You warrant that you have all necessary rights, licenses, and permissions for any content you upload or process
• You are responsible for ensuring your use complies with applicable laws, including copyright, privacy, and data protection regulations

3.3 Webflow Integration

• You must have a valid Webflow account and appropriate permissions for the sites where you use the Extension
• You are responsible for compliance with Webflow's Terms of Service
• The Extension requires Webflow Designer access and appropriate site permissions

4. PROHIBITED USES

You may not use the Extension to:

• Process illegal, harmful, threatening, abusive, or defamatory content
• Generate or enhance images that violate intellectual property rights
• Create content that violates Google's AI usage policies
• Attempt to reverse engineer, decompile, or extract the Extension's source code (beyond what is publicly available)
• Use the Extension for commercial purposes that violate any applicable terms of third-party services
• Process personal data without appropriate legal basis under applicable privacy laws

5. THIRD-PARTY SERVICES

5.1 Google AI Studio Integration

• The Extension integrates with Google's AI services using your API credentials
• Your use of Google's AI services is governed by Google's terms and policies
• We are not a party to your agreement with Google and assume no responsibility for Google's services
• Service availability depends on Google's API availability and your account status

5.2 Webflow Platform Integration

• The Extension operates within the Webflow Designer environment
• Webflow's terms and policies apply to your use of their platform
• We are not responsible for Webflow platform availability, changes, or restrictions

6. PRIVACY AND DATA HANDLING

6.1 No Data Collection

• We do not collect, store, or process your API keys, images, or personal data
• Your API key is stored locally in your browser session only
• Images are transmitted directly from your browser to Google's API

6.2 Data Flow

• Images and prompts are sent directly to Google's AI services
• We do not intercept, store, or process this data
• Any data processing is governed by Google's privacy policies

6.3 Local Storage

• The Extension may store preferences and settings locally in your browser
• Optional API Key Storage: You may choose to save your API key in browser localStorage for convenience
• Security Warning: localStorage is unencrypted and may be accessible to other scripts - use at your own risk
• Default Behavior: By default, API keys are only stored in memory and cleared when the extension closes
• This data is not transmitted to our servers
• You can clear this data through your browser settings or the Extension's "Clear API Key" feature

7. INTELLECTUAL PROPERTY

7.1 Extension Ownership

• The Extension software (excluding third-party components) is our intellectual property
• You receive a limited, non-exclusive license to use the Extension
• This license does not grant rights to modify, distribute, or create derivative works

7.2 Generated Content

• You retain ownership of images you upload to the Extension
• AI-generated or enhanced images may be subject to the terms of the AI service provider
• We claim no ownership over your content or AI-generated results
• You are responsible for determining ownership and usage rights of AI-generated content

7.3 Open Source Components

• The Extension includes open source components governed by their respective licenses
• Open source components retain their original licensing terms

8. DISCLAIMERS AND LIMITATION OF LIABILITY

9. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the Extension
• Your violation of these Terms
• Your violation of third-party rights or terms
• Content you upload, process, or generate through the Extension
• Your use of third-party AI services
• Any legal claims related to AI-generated content
• Unauthorized access to or misuse of API keys stored in localStorage
• Security breaches related to locally stored credentials

10. TERMINATION

10.1 Termination Rights

• You may stop using the Extension at any time
• We may terminate or suspend access with or without notice
• Termination may occur for Terms violations or service discontinuation

10.2 Effect of Termination

• Your license to use the Extension immediately ends
• Locally stored data (including any saved API keys) may be retained in your browser until manually cleared
• Security Recommendation: Clear any saved API keys from localStorage after termination
• These Terms survive termination where legally enforceable

11. CHANGES TO SERVICE AND TERMS

11.1 Service Changes

• We may modify, suspend, or discontinue the Extension at any time
• We may add or remove features without notice
• Third-party service changes may affect Extension functionality

11.2 Terms Changes

• We may update these Terms periodically
• Continued use after changes constitutes acceptance
• Material changes will be communicated through the Extension or our website

12. GEOGRAPHIC RESTRICTIONS AND COMPLIANCE

12.1 Availability

• The Extension may not be available in all jurisdictions
• You are responsible for compliance with local laws and regulations
• Export control laws may apply to AI technology usage

12.2 Data Protection Compliance

• You must comply with applicable data protection laws (GDPR, CCPA, etc.)
• Processing personal data through AI services requires appropriate legal basis
• You are the data controller for any personal data processed

13. TECHNICAL REQUIREMENTS AND LIMITATIONS

13.1 System Requirements

• Compatible web browser with JavaScript enabled
• Active Webflow Designer session
• Valid third-party API credentials
• Stable internet connection

13.2 Service Limitations

• Processing limits depend on your third-party API quotas
• Image size and format restrictions may apply
• Service performance depends on third-party API response times

14. SUPPORT AND CONTACT

14.1 Support Scope

• We provide technical support for Extension functionality
• We do not provide support for third-party services (Google AI, Webflow)
• Support is provided on a best-effort basis without guarantees

15. GOVERNING LAW AND DISPUTES

15.1 Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

15.2 Dispute Resolution

Any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Vancouver, British Columbia, before one arbitrator. The arbitration shall be administered by the VanIAC (Vancouver International Arbitration Centre) pursuant to its Rules of Procedure. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

16. MISCELLANEOUS

16.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Extension.

16.2 Severability

If any provision is deemed invalid, the remaining provisions remain in effect.

16.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

16.4 Assignment

You may not assign these Terms. We may assign our rights and obligations.

16.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control.

17. DEFINITIONS

• Extension: The AI Image Enhancement for Webflow software application
• User Content: Images, prompts, and other content you provide to the Extension
• Third-Party Services: Google AI Studio, Webflow, and other integrated services
• Generated Content: Content created or modified by AI services
• API Credentials: Your authentication keys for third-party services
